2. Facilitation Only: Bid.a.land does not conduct or manage the auctions directly. Our role is to provide an online environment where auction houses can offer their properties under the terms of their agreements with us. Responsibility for auction listings, legal compliance, and transaction security lies entirely with the auction house or company listing the property.

2. Fee Structure and Payment Obligations

1. Listing Fees and Commission: Our services are provided on a contractual basis with auction houses and regulated companies. For each property listed on bid.a.land, we charge a listing fee as per the contract terms. In addition, we collect a commission based on the agreement with the auction house upon the successful auction of the property.
2. Upfront Payment Requirement: Auction houses are required to pay the listing fee in advance before their properties are displayed on our platform. This upfront payment ensures the commitment of the auction house to the auction process and allows us to provide the necessary marketing and facilitation services.
3. Security Deposit for Commission: As part of our agreement, auction houses must deposit 10% of the property's value into our account as a security measure. This deposit acts as a guarantee for the payment of the commission and any associated fees once the property is successfully auctioned. The security deposit will be held until the auction is completed and the commission is paid to us as per the contractual terms.
4. Commission Payment: The final commission amount, calculated based on the sale price and the terms of the contract, is to be settled directly from the security deposit provided. If the auction house fails to pay the agreed commission within the specified period after the auction's successful conclusion, bid.a.land reserves the right to deduct the owed amount from the security deposit.

3. Disclaimer of Liability

1. No Direct Involvement: Bid.a.land is not responsible for the actual auction process, the properties listed, or the fulfillment of any transaction. The auction houses and legal entities are solely responsible for ensuring the legality, accuracy, and completeness of their listings.
2. User Responsibility: Buyers participating in auctions through bid.a.land acknowledge that they are engaging directly with third-party auction houses, not with bid.a.land itself. We advise all users to conduct their own due diligence before participating in any auction.

4. Cooperation with Regulated Companies

1. We only collaborate with legal and regulated companies to provide auction opportunities. All agreements, contracts, and transactions are managed directly between these companies and the auction participants.
2. Transfer of Responsibility: By using our platform, users agree that bid.a.land holds no responsibility for any disputes, claims, or issues that may arise from interactions or transactions with the companies utilizing our platform.

5. Limited Liability

1. Under no circumstances shall bid.a.land or its parent company, ALand FZE, be held liable for any direct, indirect, incidental, or consequential damages arising from the use of our platform, including losses resulting from property auctions, transaction disputes, or contractual disagreements.

6. Modifications to Terms

1. Bid.a.land reserves the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting on this page.
